自由裁量权是人民警察的一项基本的权力,当前我国正处于社会转型阶段,治安工作面临着巨大的挑战,在执法实践中,公安人员对于该项权力的使用,极有可能对行政相对人合法权益构成危害,甚至影响社会稳定。观之当下,如何对其进行合理合法地控制成为当前公安机关亟待解决的问题。本文以治安管理为视角,对自由裁量权的概念及特点进行梳理,分析该项权力滥用现象及原因,并从立法、司法等方面提出控制该项权力的措施。 Discretion is a basic power of the People’s Police. At present, our country is in the stage of social transformation. Public security is faced with enormous challenges. In the practice of law enforcement, the use of this power by public security officers is very likely to exert great influence on the administrative counterparts Legitimate rights constitute a hazard, and even affect social stability. Nowadays, how to control it properly and legally becomes the urgent problem to be solved by the public security organ. This article, from the perspective of public security management, sorts out the concept and characteristics of discretionary power, analyzes the abuse of power and causes, and proposes measures to control the power from the aspects of legislation and judicature.
