在自由刑的执行过程中,司法资源配置的经济性要求刑罚执行过程中首先要考虑投入与产出的比例关系,过度和无效的投入会造成司法资源的浪费,故此,应以效率价值来衡量刑罚执行的必要性;刑罚执行过程中离不开必要的人文关怀,避免制造不必要的痛苦,这便要求在行刑过程中坚持刑罚的正义性。然而,我国的司法实践中,因片面强调判决稳定性而忽略刑罚的经济性和正义性的情况广泛存在,主要体现在已废除罪名和“刑变罚恒”的执行案件中,刑罚的效率价值和正义价值遭到破坏。为了恢复刑罚的应然价值,需要对现有的刑罚执行制度进行重构。是故,扩大假释、减刑的适用力度和赦免制度的适用范围是可以考虑的途径。
