我国目前涉外产品责任法律适用制度采用的是一般侵权行为法律适用规则,即侵权行为地规则。对比分析各国产品责任冲突法的新发展和产品责任法律适用公约之规定,表明我国相关的冲突规则存在一些缺陷。在借鉴国际公约和其他国家先进立法经验的基础上,提出了运用分割方法区分责任认定和损害赔偿的涉外产品责任法律适用新规则。
At present, the system of legal application of foreign product liability in our country adopts the law applicable to general infringement, that is, the rules of infringement. The contrastive analysis of the new developments of product liability conflict law and the law applicable conventions of product liability in various countries shows that there are some defects in our conflict rules. On the basis of drawing lessons from international conventions and other countries’ advanced legislative experiences, this paper proposes a new rule of law applicable to the liability of foreign products, which uses the division method to distinguish between responsibility determination and damage compensation.
