我国《刑事诉讼法》规定:传唤、拘传持续的时间最长不得超过12小时,不得以连续传唤、拘传的形式变相拘禁犯罪嫌疑人。《治安管理处罚法》规定:对违反治安管理行为人,公安机关传唤后应当及时询问查证,询问查证的时间不得超过8小时;情况复杂,依照本法规定可能适用行政拘留处罚的,询问查证的时间不得超过24小时。两个法律条文差别在于不得超过的最长期限。司法实践中,公安机关办理刑事案件一般在传唤24小时后才办理刑事拘留等强制措施,理由是根据《治安管理处罚法》规定。有观点认为:对有违法犯罪嫌疑的人员进行传唤,不能确定是治安案件或是刑事案件,优先适用治安案件的法律规定,待有证据证明其系刑事案件后再适用办理刑事案件的法律规定;12小时的询问、讯
