一、深圳立法状况与现存问题深圳特区建立15年来,改革开放取得了令人瞩目的成就,其中深圳立法是特区经济得以持续、稳定、健康、高速发展的重要保证.深圳特区除施行全国性法律、法规,特别是涉外经济法律、法规外,还实施广东省人大常委会通过的有关特区企业登记管理、特区企业劳动工资管理、特区涉外企业会计管理、特区企业工会、特区涉外经济合同、特区技术引进、特区土地管理、特区商品房产管理、特区抵押贷款、特区涉外公司、特区涉外公司破产、特区出入境人员管理、特区与内地之间人员往来管理等20多项单行法规以及深圳市政府为实施以上法规而制定的一系列具体的实施办法和施行细则.1992年7月,全国人大常委会决定授权深圳市制定深圳经济特区法规和规章,使深圳特区的改革由此进入新的境界.新的机遇赋予深圳有条件从其实际出发,从建立社会主义市场经济体制的需要出发,制定出符合现代社会经济发展的法规和规章,以巩固改革成果和推动改革开放的深入发展.三年来,深圳市人大及其常委会和深圳市人民政府积极从事立法工作,制定并公布了一批在深圳特区内实施的法规和规章,主要涉及以下几个方面:(1)有关市场主体及确定其法律地位并规范其组织和行为方面;(2)有关房地产管理、规范房地产转让行
