《现代行政法基本原则之重构》文:章剑生 《中国法学》2003年第3期 在中国行政法学界,现代行政法基本原则如何构建尚未获得共识。但行政法基本原则的重要意义是不言而喻的。重构现代行政法基本原则应以有效率的行政权和有限制的行政权为逻辑起点,以行政法内分为行政实体法、行政程序法、行政诉讼法为逻辑结构基础,构建起一个具有内在联系的、开放性的法原则体系,也就是以有效率的行政权为基点,确立行政行为效力推定原则、行政自由裁量原则和司法审查有限原则;以有限制的行政权为基点,确立行政职权法定原则、行政程序正当原则和多元控权必要原则。
