随着经济人文交流的频繁往来,民间自治团体加强了彼此的沟通与合作。在经济大环境下不断开拓发展,海峡两岸对彼此的需要已经是一个无可争辩的话题。上层建筑反作用于经济基础,良好的法律制度能够更好地增进海峡两岸彼此间的理解与信任,加快台湾地区的回归。20世纪中期,国民党政府迁至台湾地区,随之而来的是国民党政府推行的法律体系在台湾地区的生根发芽。今天看来,国民党政府在法制建设上对台湾地区乃至对整个新中国都做出了巨大贡献。现行“六法全书”以及台湾地区民法典为台湾地区的稳定发展做出了巨大的贡献。并且,台湾地区的法律制度基本参考借鉴德国立法例,在法学创造方面具有较高的水平。本文在此主要探讨海峡两岸地区继承法间的发展倾向,对其进行比较分析,研究彼此间存在的问题,并相应的提出解决方法或处理的建议,供立法工作者及促进祖国统一大业进一步发展之用。当前台湾地区“民法”继承法部分在吸收中国传统文化的同时,汲取大陆法系立法的先进经验(以德国为范例),具有着制度规范完备、逻辑清晰明了、稳定性强的优点。从促进祖国和平统一、维护海峡两岸人民合法利益的角度出发,大陆地区应当吸取台湾地区继承法编的有益成果,并发现其中的不足,做到相互借鉴,取长补短。从而为完善彼此立法、祖国统一做好制度准备。
With the frequent exchanges of economic and humanistic exchanges, civil autonomous organizations have strengthened their mutual communication and cooperation. Under the economic environment, it is an indisputable topic that the two sides of the strait need to keep on exploring and developing each other. The superstructure is counter-productive to the economic foundation. A sound legal system can better promote mutual understanding and trust between the two sides of the Taiwan Strait and accelerate the return of Taiwan. In the mid-20th century, when the KMT government relocated to Taiwan, what followed was the rooting of the legal system promoted by the Kuomintang government in Taiwan. Today, the Kuomintang government has made tremendous contributions to the legal system in Taiwan and even the entire New China. The current “Six Laws ” and the Taiwan Civil Code made tremendous contributions to the steady development of Taiwan. Moreover, the basic legal system in Taiwan is a reference to drawing lessons from German legislation and has a high level of legal creation. This article mainly discusses the tendency of the development of succession law between the two sides of the Taiwan Straits, comparatively analyzes them, studies the problems existing between them, and proposes solutions or solutions accordingly for lawmakers and further development of the great cause of reunification of the motherland Use. At present, Taiwan’s “Civil Law” and “Inheritance Law”, while absorbing traditional Chinese culture, draw on the advanced experience of civil law legislation in Germany as an example. They have the advantages of complete system specification, clear and logical logic and strong stability. From the perspective of promoting the peaceful reunification of the motherland and safeguarding the legitimate interests of the people on both sides of the Taiwan Straits, the mainland of China should draw on the beneficial achievements of the law of the succession of Taiwanese law and discover the deficiencies therein so as to learn from each other and learn from each other’s strengths. So as to perfect each other’s legislation, the unity of the motherland to make system preparation.
