市场经济的不断发展以及社会的不断进步,让人格权的商业价值不断提高。因此,人格权的商品化问题应当得到关注。本文主要分析人格权商品的基础理论,法律应当进行的保护模式,探讨人格权商品化法律保护模式的现状及立法的问题。并借鉴国外经验结合我国国情提出相应的完善建议。
The continuous development of the market economy and the continuous improvement of the society make the commercial value of the right of personality continuously improve. Therefore, the commercialization of the right to personality deserves attention. This article mainly analyzes the basic theory of personality right commodity, the protection mode that law should carry out, and discusses the status quo and legislative issues of legal protection mode of commercialization of personality right. And draw lessons from foreign experience with China’s national conditions and put forward corresponding improvement suggestions.
