城管和小商贩之间的暴力冲突频出,城管侵犯基本人权一说得到了社会公众舆论一定的认可,凸显城市管理领域人权保障的难题。笔者以城市管理执法改革为背景,运用人权理论揭示城市无照流动小商贩占道经营行为的多重法益侵害性,澄清有关人权保障的片面认识。
The frequent violent clashes between urban management and small-scale traders and the infringement of basic human rights by urban management have been recognized by the public opinion in the community and highlighted the problems of human rights protection in urban management. Based on the background of urban management law enforcement reform, the author uses the theory of human rights to reveal the multiple legal interests infringement of the occupational conduct of small-scale traffickers in cities and clarify the one-sided understanding about the protection of human rights.
