我国《侵权责任法》第34条和第35条关于雇主赔偿责任的规定内容较为简略,甚至在责任分担等方面和最高法《关于审理人身损害赔偿案件适用法律若干问题的解释》有较大出入,造成法律适用上的混乱。本文立足于此,紧密结合我国的立法规范,对雇主责任的性质、构成要件、归责原则、责任承担等方面进行了探讨,并最终回到立法实践,对未来我国相关立法的转向提出意见。
The provisions of Article 34 and Article 35 of the “Tort Liability Law” of our country on the employer’s liability for compensation are relatively simple and even have a large discrepancy with the Supreme People’s Court’s “Interpretation on Several Issues Concerning the Application of Law in the Trial of Personal Injury Compensation Cases” in respect of the sharing of responsibilities , Causing confusion in the application of the law. Based on the above, this article closely discusses the legislation of our country, discusses the nature, components, responsibility principle and liability assumption of employers, and finally returns to the legislative practice and puts forward opinions on the future direction of our country’s legislation.
