由传统向现代型体制迈进的过程中,教育领域纠纷已引起社会广泛关注。现阶段,由于对高校法律性质定位模糊,高校教育纠纷的复杂性逐渐使得现行纠纷解决机制捉襟见肘,难以有效解决教育领域的众多纠纷。深入研究高校教育法律关系、各种纠纷产生的原因进而在反思现有纠纷解决机制的基础上,建立一套科学、完善的法律应对措施,已经成为现在高校教育研究中的一个焦点问题。
In the process of moving from the traditional system to the modern one, disputes in the field of education have drawn widespread public concern. At this stage, due to the vague positioning of the legal nature of colleges and universities, the complexity of educational disputes in colleges and universities has gradually stretched the existing dispute resolution mechanisms and made it difficult to effectively solve many disputes in the field of education. In-depth study of the relationship between the legal education of higher education, the causes of various disputes and then on the basis of reflection on the existing dispute resolution mechanism, to establish a set of scientific and perfect legal response measures has become a focal issue in the research of higher education nowadays.
