围绕对电信企业“用户信息资料”和“通信内容”的检查权,历来都是电信企业与司法部门及政府行政执法机关争议的焦点,也是法律适用的难点。在民事案件中法院是否有要求电信企业提供用户资料、查询用户信息的权力,电信企业是否有义务配合法院调查取证或协助执行,将用户的相关资料和信息提供给法院,江苏省电信有限公司常州分公司因保护用户通信秘密而未提供相关资料受到罚款,遭遇法律适用的难题,使电信企业依法办事和依法经营活动受到强势司法权的干扰,而《宪法》和《中华人民共和国电信条例》赋予电信企业保护公民的通信自由和通信秘密的法定责任,由于规定的不明确无法保证。因此从法院查询电信用户资料引发的争议看,加快电信立法显得十分重要。
