为了保护民事主体的民事权利,我国相关法律规定了可因行为人或表意人撤销权的行使而使民事行为自始无效的情形。此举的出发点是为了协调矛盾,定纷止争。然而随着市场经济的发展,社会关系越来越趋向复杂。有时为了保护善意相对人的利益或者从更加宏观的角度出发,也即为了更好地维护社会秩序更好的促进经济发展从而更好地完善法制,我们必须对相关行为有所限制。
In order to protect the civil rights of the civil subject, the relevant laws of our country stipulate that the civil action may be nullified from the beginning by the exercise of the right of withdrawal of the perpetrator or the signatory. The starting point of this move is to coordinate contradictions and to stop disputes. However, with the development of market economy, social relations tend to be more complex. Sometimes, in order to protect the interests of goodwill relatives or from a more macro perspective, that is, to better maintain the social order and promote economic development so as to better perfect the legal system, we must impose some restrictions on relevant acts.
