回顾历史我们可以发现,制订《行政强制法》也是我国行政程序法制建设的一个历史性步骤。1989年,我国出台了《行政诉讼法》,由此揭开了行政程序法制建设的序幕。随着1996年《行政处罚法》的诞生,行政处罚从此纳入了法制轨道。1994年出台的《国家赔偿法》、1997年出台的《行政监察法》以及1999年出台的《行政复议法》,进一步加强了对行政权的法律约束。《行政许可法》于2003年正式出台,使行政许可从此有法可依。《行政许可法》出台后,我国行政程序法制体系只剩下一个空白地带,那就是行政强制还没有专门法律予以规范。为了填补
Looking back at history, we can find that the formulation of the “Administrative Coercion Law” is also a historic step in building the legal system for administrative proceedings in our country. In 1989, China promulgated the “Administrative Procedure Law”, which opened the prelude to the legal system of administrative procedures. With the birth of the “Administrative Punishment Law” in 1996, administrative punishment has been incorporated into the legal system. The State Compensation Law promulgated in 1994, the Administrative Supervision Law promulgated in 1997 and the Administrative Reconsideration Law promulgated in 1999 have further strengthened the legal restraint on administrative power. The “Administrative Licensing Law” was formally introduced in 2003, so that the administrative license can be followed from this. After the promulgation of the “Administrative Permission Law”, there is only one vacancy left in the legal system of administrative procedures in our country. That is to say, there is no special law for administrative coercion to regulate it. In order to fill
