中国近代社会历史条件决定了中国法律的近代化必须借助于外来法律,而外来法律有一个本土化的过程,不能机械照搬。从晚清政府到南京国民政府,本土化一直成为引进西法和修订中法的主要原则,并且得到了一定程度的发展。但本土化也出现了一些失误,使法律本土化的进程缓慢而曲折。今天重新回顾这段历史,从法律近代化和本土化的得失成败中吸取经验教训,对当前的法制建设无疑具有重要的启示意义。作者围绕这一主题,专访了中国政法大学郭成伟教授,下面是这次访谈的具体内容。
The social and historical conditions in modern China have determined that the modernization of Chinese law must rely on foreign laws while the foreign laws have a localization process that can not be mechanically copied. From the late Qing government to the Nanjing National Government, localization has been the main principle of introducing the Western Law and amending the Sino-France, and has been developed to a certain extent. However, there have also been some mistakes in localization, making the process of localization of law slow and tortuous. Recalling this history today and drawing lessons from the success or failure of the modernization and localization of law undoubtedly have important implications for the current legal system construction.
