环境破坏日趋严重,传统的私益诉讼无法彻底实现对公共环境的保护。环境问题的解决需要公众的广泛关注和参与,环境公益诉讼将成为有效的方式。我国现行的法律框架下,环境公益诉讼尚无立足之地,而现实状况又迫切需要此制度的构建。笔者在借鉴国外立法尤其是美国的环境公民诉讼制度后,倡议建立适合我国国情的切实可行的环境公益诉讼制度。 As the environmental damage becomes more and more serious, the traditional private interest litigation can not completely realize the protection of the public environment. Environmental issues need the public to pay wide attention and participation, environmental public interest litigation will be an effective way. Under the current legal framework of our country, there is no place for environmental public interest litigation, and the actual situation urgently needs the construction of this system. After referring to the foreign legislation, especially the environmental citizen litigation system in the United States, the author proposes to establish a practicable environmental public interest litigation system that suits our own national conditions.
