近年来由域名而致的纠纷也不断发生,但由于目前学术界对于域名的性质尚无统一之意见,各国立法也规定不一,由此导致了世界范围内域名权保护的障碍。本文旨在通过对域名权性质的探讨,比较目前世界范围内对域名的保护方法,确定对域名的保护模式,进而对我国域名保护管理体制提出进一步意见。
Disputes caused by domain names have also occurred continuously in recent years. However, due to the fact that there is no unified opinion on the nature of domain names in the academia at present, national laws and regulations are also different, which has led to the obstacles in the protection of domain name rights around the world. The purpose of this paper is to discuss the nature of domain name rights and to compare the protection methods of domain names in the world at present, to determine the protection mode of domain names, and to put forward further opinions on the protection and management system of domain names in our country.
