处于社会转型时期的中国法治,处于全球化范围之内的中国法治需要更多地参照标准来评估已有成果,吸收普适经验,修正前进方向。通过权利质量概念的提出,以“符合性”质量标准和“适用性”质量标准(尤其是后者)来分析权利质量的内涵并通过开放多学科的研究路径来勾勒权利质量的外延,尝试建立权利质量综合性评估视角,这对于中国法治的发展将是有一定意义的。
The Chinese rule of law in a time of social transition and the rule of law in China within the scope of globalization need to make more assessments of existing achievements with reference to standards, absorb universal experiences and correct the way forward.
