能源革命揭示了德国能源政策及能源法的根本性变革。作为欧洲经济与政治中心,德国将成为未来“绿色经济”发展的试验田,且“绿色增长”的成功与否将取决于其国内能源的储量及使用方式。一方面,可再生能源需要被大力的推广应用;而另一方面则涉及传统能源的高效利用。与此同时,强调能源效率的能源革命也给相关法律带来了挑战。不同领域的多种规范有必要统一到一部可以普遍适用的,内容连贯,结构完善的法律中。这一问题的高度复杂性及加速发展会带来欧盟乃至世界其他国家均需要关注的一个问题,即能源效率法——一个全新法学学科的形成。本文从能源效率法的概念谈起,延伸到法学学科发展的相关标准及能源效率法的基本结构,最后探讨能源效率法若要成为一部完善的法律仍然存在的问题和发展的前景。
The energy revolution revealed a fundamental change in Germany’s energy policy and energy law. As Europe’s economic and political center, Germany will become the experimental field for the future development of “green economy”, and the success of “green growth” will depend on the amount of its domestic energy reserves and its use. On the one hand, renewable energy needs to be vigorously promoted; on the other hand, it involves the efficient use of traditional energy sources. At the same time, energy revolutions that emphasize energy efficiency have also posed challenges to the law. Multiple disciplines in different fields need to be unified into a universally applicable and well-structured law. The high degree of complexity and acceleration of this issue will bring about one issue that needs attention from the EU and other countries in the world. That is, the Energy Efficiency Law - the formation of a new law discipline. This article starts with the concept of energy efficiency law and extends to the related standards of law discipline development and the basic structure of energy efficiency law. Finally, it discusses the problems and prospects for energy efficiency law to become a perfect law.
