《中华人民共和国未成年人保护法》和《中华人民共和国预防未成年人犯罪法》都明文规定,对犯罪的未成年人实行教育、感化、挽救的方针,坚持教育为主、惩罚为辅的原则。法庭教育是贯彻上述方针和原则的重要载体,是寓教于审的重要方式。但审判实践中发现,法庭教育机制在教育理念、有关立法、教育主体、教育程序、教育内容等方面均存在问题和不足,导致法庭教育在某种程度上“走走过场”、流于形式。本论文从少年刑事审判实践的视角对我国目前司法实践中的法庭教育状况进行分析,并从更新教育理念、完善相关立法、明确教育主体、设置弹性程序、细化教育内容等方面,对完善该项制度设计提出建议。
The Law of the People’s Republic of China on the Protection of Minors and the Law of the People’s Republic of China on the Prevention of Juvenile Crimes stipulate that the principle of education, probation and salvation shall be implemented for minors who commit crimes, education shall be supplemented, and punishment shall be supplemented in principle. Court education is an important vehicle for carrying out the above guidelines and principles and is an important way to teach in court. However, in trial practice, the court education mechanism has some problems and shortcomings in educational philosophy, relevant legislation, education subjects, educational procedures and educational contents, which leads to the court education to some extent . This paper analyzes the status of forensic education in current judicial practice in our country from the perspective of juvenile criminal trial practice. From the aspects of updating education concept, perfecting relevant legislation, defining the main body of education, setting up flexible procedure and refining educational content, Item system design put forward suggestions.
