在非西方社会,实现法制现代化的过程充满文化的冲突,并通过不同形式的文化冲突最后达到文化的融合。因此,非西方国家法制的现代化实际上是文化的冲突与融合过程。法制现代化的具体进程在不同的国家有不同的表现形式。韩国从传统社会向现代社会的转变过程中,注意协调传统法制与现代法制的相互关系,在保持法制的民族性同时,通过法律的移值吸收了西方优秀的法律文化,形成了具有灵活性与多样性的现代法制体系。韩国法制现代化的过程与经验对于我们有重要的参考价值。本文在分析韩国法制现代化历史进程的基础上,介绍了韩国学者们对法制现代化过程所做的反思,并提出面向21世纪的韩国法制的发展趋势。
In non-Western societies, the process of modernizing the legal system is full of cultural conflicts and culminating in the fusion of cultures through different forms of cultural conflicts. Therefore, the modernization of the legal system in non-Western countries is actually a process of cultural conflicts and integration. The specific process of legal modernization has different manifestations in different countries. During the transition from the traditional society to the modern society, South Korea pays attention to coordinating the relationship between the traditional legal system and the modern legal system. While maintaining the national character of the legal system, South Korea absorbed the excellent legal culture of the West through the shift of the law and formed a flexible and Diversity of the modern legal system. The process and experience of the modernization of Korean law have an important reference value for us. On the basis of analyzing the historical process of the modernization of legal system in South Korea, this paper introduces the reflections on the modernization of legal system by Korean scholars and proposes the development trend of Korean legal system facing the 21st century.
