香港版权制度肇始于英国普通法,但是以1997年7月1日香港回归祖国为标志,开启了版权制度建设的新纪元。香港图书馆版权制度涉及复制、网络传播、技术措施解密的合理使用,以及输入、保管、利用版权平行进口出版物、复制与分发侵权复制品责任豁免等多方面。香港图书馆版权制度为图书馆版权政策的建构提供了详实的法律依据、立法技术的成熟提高了版权制度的适应性、责任豁免规则保护了图书馆所代表的公共利益。
The copyright system in Hong Kong started with common law in the United Kingdom. However, marking the reversion of Hong Kong to the motherland on July 1, 1997, Hong Kong opened a new era in the construction of the copyright system. The copyright system of the Hong Kong Library involves the rational use of copying, internet dissemination and decryption of technical measures, as well as the importation, custody and parallel importation of copyrighted materials and the exemption from copying and distribution of infringing copies. The copyright system of the Hong Kong Library provides a detailed legal basis for the construction of the copyright policy of libraries. The maturity of legislative techniques has improved the adaptability of the copyright system. The rules of liability exemption have protected the public interests represented by libraries.
