实行依法治国,首先是中国共产党依法执政。中国共产党坚持依法执政,就是要从制度和法律上保证党的执政活动始终代表中国最广大人民的根本利益。1982年,党的十二大首次将“党必须在宪法和法律范围内活动”的原则写入党章。同年,宪法明确规定,“一切国家机关和武装力量、各政党和各社会团体、各企业事业组织都必须遵守宪法和法律。一切违反宪法和法律的行为,必须予以追究。”“任何组织或者个人都不得有超越宪法和法律的特权。”党的十五大把依法治国确立为党领导人民治理国家的基本方略。
To administer the country according to law is first of all the Chinese Communist Party’s ruling by law. To uphold the principle of governing according to law, the Chinese Communist Party must guarantee from the system and laws that the Party’s governing activities always represent the fundamental interests of the overwhelming majority of the Chinese people. In 1982, for the first time, the 12th National Congress of the Party wrote into the party constitution the principle of “the party must act within the limits of the Constitution and laws.” In the same year, the Constitution clearly stipulated that “All state organs and armed forces, all political parties and all social groups and enterprises and institutions must abide by the Constitution and the law, and all violations of the Constitution and laws must be investigated.” No organization or individual may have the privilege of transcending the constitution and the law. "The 15th National Congress of the Communist Party of China has established the principle of governing the country according to law as the basic strategy for the party to lead the people in governing the country.
