教唆犯的基本问题在我国刑事法领域始终是热点问题。虽然我国现行刑法将教唆犯规定在总则中,一定程度上形成了对于该问题的通说,但是为了解决教唆犯的一系列相关问题,有必要对教唆犯的基本问题进行深入的研究讨论。通过比较国外对于教唆犯的相关立法规定,从教唆犯的概念、成立要件、性质等方面入手对教唆犯的基本问题进行深入探讨,并对教唆犯的定罪及其刑事责任进行解析。
The basic problems of abettors have always been a hot issue in the field of criminal law in our country. Although the existing Criminal Law of our country stipulates abettors in the General Provisions to some extent, it has formed a general statement on this issue. However, in order to solve a series of related problems of instigators, it is necessary to conduct in-depth study and discussion on the basic problems of abettors. By comparing the relevant foreign legislation on instigators, this article discusses in depth the basic problems of instigators from the aspects of the concept of abettor, the essentials of establishment and the nature of such abettors. It also analyzes the criminalization and abetment of abettors.
