金融监管中的危机处理位于市场退出层面,它不同于日常的市场准入监管和营运监管。市场退出监管是整个金融监管目的实现的最终手段,其实施结果直接关系到整个金融体系的稳定。即便是在最有效的监管体制下,也无法完全消除金融机构陷入困境的可能性。金融监管当局必须建立一套有效的金融危机处理制度,作为金融监管体系的特殊组成部分,以便将金融机构倒闭的可能性降到最低。所有市场经济国家对金融危机都有相应的保护性措施,以便当危机发生时能够进行及时干预。
Crisis management in financial regulation lies in the market exit level, which is different from routine market access regulation and operation regulation. Market exit regulation is the ultimate means of achieving the purpose of the entire financial regulation, the implementation of which is directly related to the stability of the entire financial system. Even under the most effective regulatory regime, it is impossible to completely eliminate the possibility of financial institutions getting into trouble. Financial regulatory authorities must establish an effective financial crisis handling system as a special part of the financial regulatory system in order to minimize the possibility of financial institutions going bankrupt. All market economy countries have corresponding protective measures for the financial crisis in order to make timely intervention when the crisis occurs.
