随着人类社会的发展,人类需求的增长,人类和自然界的矛盾日益严峻。在建设法治国家构建和谐社会的背景下,解决紧迫的环境问题,协调人类与环境之间异常尖锐的矛盾,实施环境法治成为必选。实际上协调人与自然的关系也就是在环境法治中协调人类福祉和自然权利的关系,从而实现人类福祉和自然权利的有机统一。
