一、中国版权保护的现状从世界上第一部版权法--英国的《为鼓励知识创作而授予作者及购买者就其已印刷成册的图书在一定时期内权利的法》(《安娜法》)1709年颁布以来,西方的版权保护已经走过了近300年的历程。而中国第一部版权法是1910年清政府颁布的《大清著作权律》。事实上,由于中国当时的工业化进程还没有开始,清王朝也很快结束,这部法律并没有真正实施过。加上中华民族在近代以来屡遭帝国主义列强入侵,外患丛生,内忧不断,社会动荡不安,版权保护立法尽管在中华民国时期依然得到延续,但它的保护是无从谈起的。
I. The Status Quo of Copyright Protection in China From the first copyright law in the world - the British Act “to grant author and purchaser rights over a certain period of time on printed books to encourage knowledge creation” (“Anna Law ”) Since the promulgation of 1709, Western copyright protection has gone through nearly 300 years of history. The first copyright law in China was the Qing Dynasty Copyright Law promulgated by the Qing government in 1910. In fact, since the industrialization process in China was not yet started, the Qing dynasty also ended soon. This law has not really been implemented. In addition, since the Chinese nation has been repeatedly invaded by the imperialist powers in modern times, the foreign plagues have been generating troubles, internal worries and social unrest have risen. Although the copyright protection legislation still continues in the Republic of China, its protection can not be discussed.
