经营者为了保护自己的财产权利不受侵犯,采取一些可能损害消费者人格权的措施,如强制存包、安装监控摄像头等。由此产生了经营者财产权利和消费者人格权利发生冲突的问题,Ca-labresi与Melamed模型在上述问题的分析解决中可资借鉴。法官在裁量该类争议时,对于人格尊严权应当谨慎判断,看它是否有侵权行为以避免权利滥用;对于人身自由权应当按照不可让渡的权利进行保护;而对于隐私权这种并非不可让渡的权利,则应当应用模型中的责任规则进行保护。
In order to protect their own property rights from infringement, operators should take measures that may damage consumers’ right of personality, such as compulsory parcel storage and the installation of surveillance cameras. As a result, there is a conflict between the property right of the operator and the personality right of the consumer. Ca-labresi and Melamed models can be used in the analysis and solution of the above problems. Judges in the determination of such disputes should exercise due diligence in determining the right of human dignity to see if it has any infringement to avoid abuse of rights; to protect the rights to personal liberty according to the non-transferable rights; and to do so, The right to transition should be protected by applying the rules of responsibility in the model.
