社会管理创新是指在现有社会管理条件下,运用现有的资源和经验,依据政治、经济和社会发展态势,尤其是依据社会自身运行规律乃至社会管理的相关理念和规范,研究并运用新的社会管理理念、知识、技术、方法和机制等,对传统管理模式及相应的管理方式、方法进行改造、改进和改革,建构新的社会管理机制和制度,以实现社会管理新目标的活动或者过程。行政法视野下实现社会管理创新的路径为:结合行政组织法律制度的转变,实现社会管理主体的创新;以人为本,解决民生问题;综合运用多种管理手段,转变管理模式;加快完善社会管理的法律体系;完善社会纠纷解决机制。
