改革开放以来,我国社会主义法治化建设取得了卓有成效的功绩,实现了从法制到法治的蜕变。在社会主义法治的探索和发展过程中,我们在理论和实践上逐步解决了中国要不要搞法治、要搞什么样的法治、如何搞法治这三个重大课题,明确了中国法治的发展方向、目标和道路。对于法治形式要件与实质要件的内涵,以及两者在法治建设历史进程中角色扮演的研究分析,有利于我们更好地把握社会主义法治的建设方向,构建和谐而又健全的法治国家。
