米尔建.R.达马斯卡教授在《漂移的证据法》一书中认为,英美普通法的证据法日渐过时,而大陆法却在大量借鉴英美普通法中那些过时的证据规则,因此,证据法总的发展方向是:“徘徊在两个世界之间,一个已经死亡,另一个无力诞生。”其实,这是一种悲观的误解,至少在刑事证据法领域内是如此。犯罪控制与人权保障这两大刑事诉讼价值在不断冲突中又日趋平衡,与之相应,证据法的发展方向具有日渐融合刑事诉讼两大价值的趋势,体现出犯罪控制价值和人权保障价值的平衡。
In his book The Evidence on Drifts, Professor M. Damask argues that the evidence law of common law in the United States and the United States is becoming obsolete, whereas Continental Law, on the other hand, draws heavily on the outdated rules of evidence in the Common Law of England and the United States. Therefore, The general direction of development of the law of evidence is: “Hovering between two worlds, one dead and the other incapable of birth.” Actually, this is a pessimistic misunderstanding, at least in the area of criminal law of evidence. Correspondingly, the development direction of the law of evidence has the tendency of merging the two major values of criminal procedure gradually, reflecting the balance between the value of crime control and the protection of human rights .
