非营利法人从事营利活动既是一种既存事实,又是非营利法人生存和发展的需要。非营利法人存在形式多种多样,他们都是法人制度中的重要组成部分。根据最终目的区分营利法人与非营利法人,越来越多的非营利法人从事营利活动。本文从郭美美事件引出,来阐述非营利法人的特征,非营利法人从事营利活动中遇到的问题,以及提出一些相应的建议。
Nonprofit corporations engaged in profit-making activities are both an existent fact and the need of non-profit corporations for survival and development. Non-profit corporations exist in various forms, all of which are an important part of the legal system. According to the ultimate goal of distinguishing for-profit corporations and non-profit corporations, more and more non-profit corporations engage in profit-making activities. This article leads from the Mei-Mei Guo incident to explain the characteristics of non-profit corporations, nonprofit corporations engaged in profit-making activities, as well as some suggestions.
