农村土地承包经营权信托流转,能促成农业现代化、集约化经营,增加农民收益,实践中涌现如绍兴、草尾、宿州等模式。但因法律关系构建混乱、监管机制不健全、相关法律规范缺位,模式运行面临瓶颈。未来农村土地承包经营权信托流转发展,应从规范信托流转关系、完善监管制度、完善现行基础法律法规入手,健全农地信托制度。
The transfer of rural land contracting and management rights trust can lead to the modernization of agriculture, intensive management and increase of farmers’ income. In practice, such modes as Shaoxing, Caowei and Suzhou appear. However, due to the chaotic legal relationship, the regulatory mechanism is not perfect, the lack of relevant legal norms, model operation is facing a bottleneck. In the future, the rural land contractual management right trust transfer development should start from the standardization of the transfer of trust relations, improve the regulatory system, improve the existing basic laws and regulations, and improve the farmland trust system.
