在地方环境公益诉讼多年试点实践基础上,2012年新修正的《民事诉讼法》首次在国家立法中确立环境公益诉讼制度,但《环境保护法(修正案草案)》公开征求意见稿却对之只字未提。我国环境公益诉讼制度的未来进路并不清晰。环境司法与环境执法面临同样的法治环境、政治环境和社会环境,同样的孱弱;政府主导的环境公益诉讼试点实践难以成为环境公益制度发展的常态;环境执法与司法的分权、环保部门的行政扩权与公益诉权的关系等深层次问题仍有赖于理论和立法的跟进和创新。
On the basis of many years of pilot experiments in local environmental public interest litigation, the newly amended Civil Procedure Law of 2012 established for the first time an environmental public interest lawsuit system in national legislation, but the Public Opinion on Environmental Protection Law (Draft Amendment) No mention. The future path of China’s environmental public interest litigation system is not clear. Environmental justice and environmental law enforcement face the same rule of law environment, political environment and social environment, the same weakness; the pilot practice of government-led environmental public interest litigation is difficult to become the norm of environmental public welfare system development; environmental law enforcement and judicial decentralization, the environmental protection department’s administration The deep-seated problems such as the relationship between the right to expand and the right to public interest still depend on the follow-up and innovation of the theory and legislation.
