检察机关在查办职务犯罪过程中往往涉及关联案件。为了厘清职务犯罪事实,提高案件诉讼效率,并案侦查作为一种新型职务犯罪侦查方式,逐步应用到检察机关的司法实践中。《人民检察院刑事诉讼规则(试行)》的颁布施行,对于检察机关并案处理关联案件作了规范性指导,但是有关并案侦查的程序运行在刑事诉讼法中尚未明确,司法实践中还存在一些现实困境,值得我们深入探析。
Procuratorial organs in the investigation of job-related crimes often involve related cases. In order to clarify the fact of duty crimes and improve the efficiency of case lawsuits, the case investigation as a new type of duty crime investigation method is gradually applied to the judicial practice of procuratorial organs.
