山寨,就是通过模仿,制作名牌手机等产品以及他人的文艺作品和知名建筑等行为。比如说山寨手机,虽然在内在技术上与传统的诺基亚手机相比,采取了MTK芯片等新兴技术,没有侵犯到诺基亚手机的专利权,但是在外观设计上与诺基亚手机基本相似,侵犯了外观设计专利权,同时山寨手机和品牌手机在标识上基本相似,因此存在不正当竞争现象,此外还侵犯了品牌手机的商标权。因此,本文结合法律规范,着重分析山寨产品的侵权行为,为保护品牌手机的专利权提供重要依据,同时也从根源上解决山寨现象。
