建筑工程施工合同是建筑工程的重要合同。合同的管理也是建筑工程项目管理中的一项重要内容。但目前合同的管理却是建筑工程项目中的一个薄弱环节。虽然《中华人民共和国合同法》和《建设工程施工合同管理法》已出台,但是在合同签订过程中,工程建设的参与双方缺乏市场经济所必须的法制观念和诚信意识,不正当竞争行为时有发生,承包方和发包方双方合同自律行为较差,加之市场机制又难以发挥应有的作用,从而导致了建筑市场经济秩序的混乱,因此必须对建筑工程施工合同管理加以规范,促进建筑市场的健康有序的发展。
