法院人员分类管理是本轮司法体制改革的重要内容。根据改革要求,法院人员被分为法官、司法辅助人员和司法行政人员.各自的比例相应为39%、46%和15%。但在实现法院人员分类管理的改革过程中,由于法院既有的结构特征、诉讼制度、组织模式等深层次原因未被充分关照,加之相关的基础研究薄弱和实践总结不到位等情况存在,导致一些改革措施存在合法性欠缺、合理性不足、实效性未经检验和操作性有待强化等问题。应当以积极开放的姿态,充分吸纳公众意见,责权利一体构建,各项改革统一推进,实现法院人员自动分流,真正实现法官的专业化、职业化和精英化。
The classification management of court personnel is an important part of this round of judicial system reform. We should take a positive and open attitude, fully absorb the public opinions, build the one with the right and the benefit of the other, promote the uniform reform of all the courts, and automatically separate the court personnel so as to truly realize the professionalization, professionalization and elitism of the judges.
