王泽鉴教授以“任督二脉”做比喻的负担行为与处分行为,即我们所理解的债权行为与物权行为。由这两个行为所抽象出的“法律行为”的概念也成为了民法领域的核心,其中物权行为理论的规范结构可拆作分离原则与抽象原则两部分。基于对物权行为理论的不同态度,所有权如何依法律行为变动也不一样,进而影响交易的效力。具体又可以包括对交易的安全与公平两方面的影响。本文在分析物权行为无因性理论的优点和功能的同时,正视学界存在的否定意见,意识到机械的奉行该原则可能出现的问题。故在相对无因性理论的基础上,提出了新的应对机制,从而使得无因性理论能够最大程度地保护交易安全,兼顾交易公平。

Based on the different attitudes toward the theory of real rights and interests, how the ownership changes according to the legal acts is also different, thus affecting the effectiveness of the transaction. This can in particular include both the security and fairness of the transaction. While analyzing the advantages and functions of the theory of non-causality of real rights and interests, this thesis addresses the negative opinions in academia, and realizes the problems that machinery may follow when implementing this principle. Therefore, on the basis of relative non-causal theory, a new coping mechanism is put forward so that non-causal theory can maximize the security of transaction and give consideration to fair trade.
