从权利来源的角度阐述了我国高校学生权利的法律依据,并从内涵上对高校学生权利进行了界定。从现实的角度着重分析了当前我国高校学生的受教育权、参与民主管理权、人身权、物质保障权、救济权等权利的保护存在的问题。运用社会主义法治理论、我国高等教育现代化理论作为我国高校学生权利的法律保护的理论基础,提出了构建我国高校学生权利法律保护的构想:树立高校内部权力运行的法治化理念、完善我国高校学生权利保护的法律制度、完善高校校纪校规体系等。从发展的角度提出高校内部权力的运行必须要以保障学生权利为根本,这既是大学生健康成长的需要,也是我国高等教育现代化发展的需要。
From the perspective of the source of rights, this paper expounds the legal basis of the rights of college students in our country and defines the rights of university students from the connotation. From a realistic point of view, the present problems of the right to education of university students in our country and the protection of right to democratic management, personal rights, material rights and remedies are analyzed emphatically. Using the theory of socialist rule of law and the theory of modernization of higher education in our country as the theoretical basis for the legal protection of the rights of college students in our country, the author puts forward the conception of legal protection of the rights of college students in our country: establishing the concept of rule of law in running the internal power of colleges and universities and perfecting the rights of college students Protect the legal system, improve the system of school rules and regulations and so on. From the perspective of development, it is necessary to run the internal power of colleges and universities to protect the rights of students, which is not only the need of healthy growth of students but also the need of the development of higher education in our country.
