2011年全国人大常委会颁布的“精神卫生法草案”明确了精神病人强制治疗的收治标准和复核程序,但是由于这些规定仍未跳出医疗程序的范畴,使得无论是精神病人还是精神正常的公民,合法的权益仍然难以得到保证。比较分析台湾地区的立法经验,精神病人的强制治疗制度应在确立收治标准的同时,明晰法律保留、比例原则、公权力介入三大适用原则,将强制治疗的最初决定权交给医治方以外的第三方,同时在复核程序中引入司法程序。
The Draft Mental Health Law promulgated by the Standing Committee of the National People’s Congress in 2011 clarified the acceptance criteria and review procedures for the compulsory treatment of mental patients. However, since these provisions have not yet out of the scope of the medical procedure, neither mental nor mental health norms Citizens, the legitimate rights and interests are still difficult to be guaranteed. Comparative analysis of the legislative experience in Taiwan, the compulsory treatment system for mental patients should establish the criteria for admission at the same time, the legal reservation, the principle of proportionality, the involvement of the public authority of the three major principles of the mandatory treatment of the initial decision-making power to the outside Third parties, at the same time, introduce judicial proceedings in the review process.
