情势变更是指合同有效成立后,因不可归责于双方当事人的事由而发生情况变化并导致合同成立的基础完全丧失,如继续履行合同会造成显失公平的后果,应当允许当事人请求法院变更或者解除合同。在商标授权确权行政案件中不能适用情势变更原则,主要理由如下:一是商标授权确权行政案件中所涉利益关系超出合同双方当事人利益关系的范围。二是在商标授权确权行政案件中适用情势变更原则,将造成更大的不公平。三是在商标授权确权行政案件中,并不存在适用情势变更原则的合法客观情况。四是在商标授权确权行政案件中适用情势变更原则,将混淆情势变更与正常商业风险的界线。商标授权确权行政案件中不适用情势变更原则后,对商标权有争议的人依然可以视情况获得商标法的救济。
