本文借助发生在凉山彝族地区的三个案例,将国家法与习惯法的关系还原到具体情境中去观察和讨论。文章指出,在规范文本乃至法律运作的现实过程中,由于知识系统、价值观念及具体程序性等差异,国家法与彝族习惯法之间的断裂和冲突现实存在;但同时,在纠纷解决活动中,当事人,第三方“德古”甚至包括国家司法机关在内,都并非囿于二元化的思维模式,而是体现出多元化的规范或权威之间相互利用、配合和弥补的趋势。我们需对学术话语所建构的二元分离加以反思,而超越“二元”模式的真正契机往往不是从立法领域,而是从司法及法律实践领域开始的。
In this paper, with the help of the three cases that occurred in Liangshan Yi region, the relationship between national law and common law was restored to the specific situation to observe and discuss. The article points out that in the actual process of standardizing the text and even the operation of the law, due to the differences in knowledge systems, values and specific procedures, the break-up and conflict between the state law and the customary law of Yi exist in reality. At the same time, The parties and the third party “Degu ”, even including the national judiciary, are not based on the dualistic mode of thinking but on the tendency of pluralistic norms or authorities to utilize, cooperate and make up with each other. . We need to reflect on the binary separation of academic discourse. The real opportunity to go beyond the “binary” model often starts not from the field of law but from the field of judicial and legal practice.
