行政伦理是一种规范伦理,与主要追求个人道德品性的完善的美德伦理不同,它更强调以法律法规约束公职人员的作为。行政伦理的这种属性决定了行政伦理建设必须走法治化的道路。本文就是首先明确行政伦理的本质属性,分析了将其错误定位为美德伦理的逻辑矛盾和脆弱性,并借鉴西方国家的有关经验,就我国行政伦理法治化提出了初步设想。
Administrative ethics is a kind of normative ethics, which is different from the perfect virtuous ethics that mainly pursues personal moral character. It emphasizes on restraining public servants by laws and regulations. This attribute of administrative ethics determines that the construction of administrative ethics must take the road of legalization. This paper first clarifies the essential attributes of administrative ethics, analyzes its logical contradiction and vulnerability of virtue ethics, and draws lessons from the relevant experience of western countries to put forward the tentative plan for the legalization of our administrative ethics.
