※【问题提示】※房东明知承租人从事卖淫活动而出租房屋的行为如何定性※【要点提示】※房东明知承租人从事卖淫活动,仍将房屋出租给承租人,其行为符合容留卖淫罪的犯罪构成。此种情形与一般的容留他人卖淫行为有所不同,关键在于如何认定“房东明知承租人在其出租房内从事卖淫活动”。司法实践中应根据主客观相一致原则,紧紧围绕“明知”这一主观要素审核认定证据。
