证明标准是刑事司法重要组成部分,也是诉讼成败的关键。我国刑事诉讼的证明标准是:案件事实清楚,证据确实、充分。传统的证明标准有法律真实说和客观真实说。我国刑事诉讼的证明标准就采用法律真实说。通过对我国刑事司法证明标准和西方刑事司法证明标准的分析,从中吸取了西方先进合理的证明标准,将它与我国刑事司法证明标准相结合,就形成了具有中国特色的证明标准——确信无疑。
