案情回放章某与某食品公司签订了劳动合同,明确约定工作岗位为行政人事部经理。2003年该公司在没有与章某协商并且没有通知章某的情况下,突然在公司的管理层会议上宣布:章某所在的行政人事部被并入总务部,并被分拆成两个下属部门:人事部和行政部,章某被任命为行政部主管。对此章某表示不能接受,与该公司总经理多次协商未果。章某认为公司单方面变更劳动合同,原劳动合同无法继续履行,公司实际上已经单方面解除了劳动合同。因此要求公司承担违约责任,支付解除劳动合同经济
