在当前治理整顿经济过程中,实施企业法遇到许多实际问题,应引起有关机构的高度重视。1.企业法在立法指导思想上过于超前。该法的许多条文忽视了我国经济运行中各种问题的复杂性,许多条文在现实中难以实施。如企业法第32条规定,企业有权决定机构设置及其人员编制,但现实中根本行不通。
