一、对农民工存在的问题 (一)劳动权益难以得到保障劳动合同不规范。我们发现,一些中心、分公司随意招用务工人员,为了减少人员经费的支出, 则不与劳务人员及时签订有关劳动合同,存在着能拖则拖的现象。有的单位虽然签订了劳动合同,但存在很多无效条款。在劳动合同的文本中,对农民工的规定的义务条款多,权利体现少。如员工的工资、福利、工时等都没有明确规定。工资报酬普遍较低。有部分单位将农民参保的费用直接从农民工的工资中扣除,不能严格按照上海市政府的有关规定执行。特别是女性不在养老保险和医疗保险覆盖范围之内,也就无法享受生育保险待遇。
