在中国现阶段的环境法学研究中,表现出一些以非法学方法研究环境法学问题的倾向,包括以国家政策或领导人讲话为基础阐释环境法律的“行政解释学”倾向,以成本-效益为唯一分析方法而排斥其他研究方法的“经济学帝国主义倾向”以及在环境科学、生态学不断发展背景下,不同学科话语转换缺失的问题倾向。这影响了环境法学研究的深度和广度,也造成环境法学研究成果难以被法律实践所应用。环境法学是法学学科的一个分支部门,在研究目的及研究和应用方法上必然应当具备法学的特质。法学研究以实践为基础,主要解决价值判断问题,在方法上注重运用以权利义务分析为根本特征的法律思维。因而研究环境法学应当遵循法学的研究方法,主要是运用法律思维解决价值判断问题。
In the study of environmental law in China at this stage, some tendencies to study environmental law problems in an illegitimate way have been shown, including the “administrative hermeneutics” tendency of interpreting environmental laws based on state policy or the speech of the leader, and the cost- The “economic imperialism tendency” in which efficiency is the only analytical method and excludes other research methods and the tendencies of discourse transformation in different disciplines under the background of continuous development of environmental science and ecology. This has affected the depth and breadth of environmental law research, but also resulted in environmental law research results difficult to be applied by legal practice. Environmental law is a branch of jurisprudence and must have the characteristics of law in the research purpose, research and application methods. Based on practice, the study of law mainly solves the problem of value judgments and pays attention to the use of legal thinking based on the analysis of rights and obligations. Therefore, the study of environmental law should follow the law of research methods, mainly the use of legal thinking to solve the problem of value judgments.
